East Lyme To Hold Hearing On Increasing Water Sewer Rates

EAST LYME, Conn. People in East Lyme can voice their opinions on proposed increases to water and sewer rates at a hearing on Tuesday night.

The Water and Sewer Commission is proposing a five percent increase for water and a three percent increase on sewer services.

Public works says the move is needed to deal with aging infrastructure.

A hearing on the proposal will begin Tuesday night at 6:30 p.m. at the East Lyme Town Hall at 108 Pennsylvania Avenue in Niantic.

Oswegatchie Hills Developer Still Wants Added Sewage Capacity From East Lyme

East Lyme A developer proposing to build affordable housing in the Oswegatchie Hills recently filed a lawsuit against the town to overturn recently passed laws it says could prevent it from gaining and keeping greater sewer capacity in the future.

The new laws were adopted in January by the Water and Sewer Commission as an effort to better manage the towns ever-dwindling amount of remaining sewage capacity, First Selectman Mark Nickerson, who also chairs the towns Water and Sewer Commission, had said.

After the town was forced by court order to allocate nearly half its remaining capacity 118,000 gallons total to Landmark Development of Middletown in December, officials estimated the town had around 161,000 unallotted gallons to still use. But with several incoming developments in the pipeline over the coming years, that number, they said, would quickly drain, leaving officials questioning whether a water and sewer moratorium is needed.

The changes approved in January dictated the number of years a developer could hold on to its capacity, as well as who must apply for capacity, among other stipulations. The idea behind the policy change, Nickerson had said, was to ensure that developments could not hold on to allotted capacity without a timely intention to build.

Landmark said it needed 118,000 gallons of sewer capacity to accommodate its proposed units and was granted that after a protracted court battle with the town.

In this administrative appeal the issue concerns the construction and application of General Statutes § 1-21 . This provision relates to the “Executive Sessions” of a public agency, and is a component of the Freedom of Information Act General Statutes § 1-7 et seq.

The public agency involved in this case is the plaintiff, the East Lyme Water and Sewer Commission. The respondents are the Freedom of Information Commission and Mr. Joseph Mingo, a member of the East Lyme Water and Sewer Commission .

The plaintiff is an agency of the town of East Lyme and a public agency for the purposes of the FOIA. The FOIC is an agency of the State of Connecticut empowered to enforce the FOIA, General Statutes § 1-21j.

General Statutes § 1-21 provides in pertinent part CT Page 391-H ” At an executive session of a public agency, attendance shall be limited to members of said body and persons invited by said body to present testimony or opinion pertinent to matters before said body provided that such persons’ attendance shall be limited to the period for which their presence is necessary to present such testimony or opinion and, provided further, that the minutes of such executive session shall disclose all persons who are in attendance. . . .”

The FOIC found that East Lyme had violated the FOIA, CT Page 391-I specifically General Statutes § 1-21g.

With Dwindling Sewage Capacity East Lyme Questions Potential For Growth

East Lyme With towns sewage capacity nearing its limit, officials are wondering whether they might need to place a moratorium on developments beyond those in the pipeline.

After a recently upheld court ruling, town officials were forced in December to allocate 45 percent of the towns estimated remaining capacity to Landmark Development for a proposed 840-unit housing development set over 236 acres in the towns Oswegatchie Hills spurring discussions on what recently has become an obvious capacity issue.

With just 161,000 daily gallons now left to allot, and several incoming developments expected to take a majority of that capacity, First Selectman Mark Nickerson briefly mentioned the possibility of a moratorium at a Board of Selectmen meeting earlier this month, stating that he was working with the towns attorney to determine the legality of that.

In an interview last week, Nickerson said he has only discussed the issue briefly with the Water and Sewer Commission, which he chairs, and that, Maybe that is our next step, but we dont know. He said, if one were put in place, it would be up to the commission to do so.

I dont know the legality of it, thats my honest answer. I cant speak to it, he said, before stating that the town soon may need to consider possible solutions to find capacity elsewhere a topic that he also is beginning to discuss with his commission, he said.
